Power needs a form—and a limit.

Eight modules test how rights, competence, money, ownership, justice, safety and crisis could be governed in a Deluist order.

00 · Status

A workshop, not a finished constitution.

The modules translate Deluist principles into contestable articles. Every proposal names oversight and an unresolved alternative. None has legal force.

Fundamental rights and equal freedom

  1. Art. I.1

    The dignity, physical and mental integrity and equal freedom of every person bind every public and communal body.

  2. Art. I.2

    Freedom of expression, conscience, assembly, association, movement and information may not be abolished by local majorities.

  3. Art. I.3

    Social rights to essential provision become progressively justiciable; scope, resources and remedies must be defined by law.

Constitutional control

Direct constitutional complaint; independent courts; free initial review for existential interference.

Competing variant

It remains open whether social guarantees should be individually enforceable or institutional duties with minimum standards.

Competence and federation

  1. Art. II.1

    A task belongs to the lowest level able to perform it effectively, consistently with rights and without materially exporting harm.

  2. Art. II.2

    Every higher competence states its purpose, financing, data duty, oversight body and next expiry or review date.

  3. Art. II.3

    Delegates are bound by published aims and limits, accountable and recallable through due process.

Constitutional control

Open competence register; competence court; mandatory periodic review for returning powers.

Competing variant

The threshold at which cross-border effects require a higher level, and who carries the burden of proof, remains open.

Legislation and participation

  1. Art. III.1

    Laws arise through elected representation, direct political rights and representative deliberation; law defines their interaction.

  2. Art. III.2

    Before long-term or hard-to-reverse decisions, an accessible impact, minority and reversibility assessment is published.

  3. Art. III.3

    Political participation is materially enabled through time, payment, care, translation and offline access.

Constitutional control

Transparent interests; independent sortition; public duty to answer recommendations.

Competing variant

It remains open which matters must trigger a civic panel, a referendum or both.

Finance, taxation and money

  1. Art. IV.1

    Taxes finance equal freedom, common infrastructure and ecological repair according to economic capacity.

  2. Art. IV.2

    Budgets disclose aims, distribution, long-term liabilities and ecological effects in accessible form.

  3. Art. IV.3

    Monetary and credit arrangements prevent private or public monopoly power; operational independence remains tied to democratically set goals and accountability.

Independent audit office; open budget data; debt and asset register; judicial protection against arbitrary levies.

Competing variant

The roles of a central bank, public banks and decentralised credit cooperatives remain subject to competing models.

Economic order and ownership

  1. Art. V.1

    Personal possessions and self-directed life are protected. Ownership of productive and natural resources entails duties to workers, affected people and the environment.

  2. Art. V.2

    Workers hold rights to information, organisation and graduated co-decision over strategic enterprise questions.

  3. Art. V.3

    Natural monopolies and critical networks are publicly, cooperatively or equivalently democratically governed.

Constitutional control

Compensation and transition are regulated by law, proportionately and subject to judicial review; provision may not be shut down as leverage.

Competing variant

Thresholds for co-determination, socialisation and user chambers remain political questions.

Justice and independent oversight

  1. Art. VI.1

    Courts decide independently, with public reasons and within statutory time limits.

  2. Art. VI.2

    Judicial selection combines competence, pluralist legitimacy, limited tenure and protection from political retaliation.

  3. Art. VI.3

    Ombuds, privacy, anti-corruption and audit oversight may not sit within the same chain of command.

Open judgments; random case allocation; recusal rules; independent budgets under democratic aggregate control.

Competing variant

The balance among democratic election, professional selection and term limits remains under comparison.

Police, safety and defence

  1. Art. VII.1

    Coercion may be exercised only under law, when necessary, proportionately, documented and individually challengeable.

  2. Art. VII.2

    Police are locally accountable but bound by uniform rights, training and data standards.

  3. Art. VII.3

    Defence protects the population, democratic order and territorial security; it may not serve a party, guild or person.

Constitutional control

Independent complaints body; parliamentary and civilian oversight; judicial review of covert measures.

Competing variant

Territorial militia, professional core, civil resilience and international security cooperation remain competing models.

Crisis and extraordinary power

  1. Art. VIII.1

    Extraordinary power requires a specifically established danger, narrow purpose, short deadline and named responsible body.

  2. Art. VIII.2

    The core of human dignity, prohibition of torture, judicial remedy and political opposition remains inviolable.

  3. Art. VIII.3

    Permanent ownership, electoral or constitutional changes may not be enacted under emergency law alone.

Constitutional control

Automatic expiry; immediate notice to an oversight body; continuing judicial review; independent final report.

Competing variant

The maximum initial duration and rules for highly confidential threats remain open.

No article without a way to challenge it.

The first consultation focuses on informal elites in federated self-government. Submissions can propose amendments, counter-articles or deletion.
